# Terms of Service — ClearVision

## 1. Acceptance of terms

By downloading, installing, accessing, or using the **ClearVision** mobile application and any related services (together, the **“Service”**), you agree to be bound by these Terms of Service (**“Terms”**). If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

## 2. Description of the Service

ClearVision is a productivity and digital-wellbeing tool that may include, depending on your device and permissions:

- **App blocking:** Restricting or shielding access to apps you select (for example, via Android accessibility-related features and/or Apple’s Screen Time / Family Controls–style APIs, as implemented in the app).
- **Focus sessions:** Tracking or structuring periods during which blocking or focus mode is active.
- **NFC triggers:** Optional use of NFC tags or similar mechanisms to toggle or control certain in-app states (for example, via a custom URL scheme such as `clearvision://`).

The exact behavior depends on your **device model, operating system version, permissions you grant, and third-party platform policies**. We do not guarantee uninterrupted operation, compatibility with all devices, or that blocking will work in every scenario.

## 3. Acceptable use

You agree to use the Service **only in a lawful manner** and in line with its intended purpose (personal focus and reducing distraction).

You agree **not** to use the Service in a way that:

- **Endangers safety or public order**, or interferes with **emergency communications**, **medical**, or **critical safety** workflows you may rely on.
- **Blocks, disables, or impairs** apps or system functions in a way that could make your device **unusable**, prevent **system updates** or **security patches** where you are responsible for applying them, or violate **platform rules** (Google Play, Apple App Store, etc.).
- Circumvents technical measures, reverse engineers the Service beyond what applicable law expressly permits, or uses the Service to harm third parties or their systems.

**You are solely responsible** for which apps you choose to block and for ensuring that your configuration remains appropriate for your personal, professional, and safety needs.

## 4. Limitation of liability

To the **fullest extent permitted by applicable law**:

- The Service is a **tool you configure**. We are **not liable** for any **direct or indirect** damages arising from your use or inability to use the Service, including but not limited to: **missed notifications, messages, calls, alarms, calendar events, financial transactions, medical reminders, or other time-sensitive information**; **lost profits, data loss, or business interruption**; or **consequences of blocking or failing to block** any application.
- We do not warrant that the Service will **detect, block, or allow** apps correctly in all cases, or that it will operate without **errors, delays, or conflicts** with OS updates, manufacturer customizations, or other apps.
- Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the **maximum extent permitted by law**. Nothing in these Terms excludes or limits liability where such exclusion or limitation would be **void** under mandatory law (for example, **gross negligence**, **willful misconduct**, or **personal injury** caused by our fault, where applicable).

## 5. Warranty disclaimer

The Service is provided **“as is”** and **“as available”**, **without warranties of any kind**, whether express, implied, or statutory, including implied warranties of **merchantability**, **fitness for a particular purpose**, **title**, and **non-infringement**, to the fullest extent permitted by law.

We do not warrant that the Service will meet your requirements, be **uninterrupted**, **secure**, or **error-free**, or that defects will be corrected.

## 6. Termination and changes to the Service

We may **suspend**, **discontinue**, or **stop supporting** the Service, or any feature of it, **at any time**, with or without notice, for operational, legal, security, or business reasons.

You may stop using the Service at any time by ceasing use and, if applicable, uninstalling the app.

Upon termination, provisions that by their nature should survive (including **limitations of liability**, **warranty disclaimers**, and **governing law**) will remain in effect to the extent applicable.

## 7. Governing law and disputes

These Terms are governed by the laws of **France**, **without regard to conflict-of-law principles**, except where mandatory rules of your country of residence as a consumer provide otherwise.
